Fleeing Arrest Leads to DWI Charges for Minnesota Woman

BURNSVILLE, MINNESOTA - According to a criminal complaint, around 9:20 PM on Sunday, September 24, 2023, Minnesota State Troopers were called and responded to a complaint of a vehicle that was driving erratically on southbound I-35E near Burnsville, Minnesota. The caller reported that the vehicle could not maintain its lane and was weaving in and out of the lane and onto the shoulder. When the Officer got to the location of the vehicle on southbound 35E, they observed the vehicle weaving in and out of the lane as well, which prompted the Officer to initiate a traffic stop on the vehicle.

When the Officer initiated his emergency lights, the vehicle changed lanes and began to exit the highway, not stopping for the Officer. The Officer then activated his siren and had the lights on, at which point the vehicle reportedly made an evasive maneuver back onto southbound I-35E instead of taking the highway exit. The vehicle eventually took the exit for County Road 11, which was when the Officer performed a PIT maneuver on the ramp to stop the vehicle. The PIT caused the vehicle to spin out, but the Suspect vehicle could keep driving. The Officer then performed a second PIT maneuver on the vehicle while trying to enter a neighborhood. The Suspect attempted to drive out of the PIT maneuver again but struck another vehicle at the intersection. The Officer stopped the Suspect's vehicle with his squad as backup arrived to assist the Officer. No injuries were reported in the second car that was hit.

The two occupants of the Suspect vehicle were uncooperative and would not get out of the car, but they would eventually be taken into custody. The driver of the vehicle was identified as 46-year-old Kizzie Froysland. The passenger was not identified in the criminal complaint. As Ms. Froysland was being arrested and searched, an Officer could smell a strong odor of alcohol coming from Ms. Froysland, noticing she had bloodshot, watery eyes, and slow motor functions. Ms. Froysland was given a preliminary breath test showing an alcohol concentration of 0.177, or around 2.2 times the legal limit.

Ms. Froysland was officially arrested around 9:45 PM and taken to the Dakota County Jail, where she was read the Breath Test Advisory and allowed to contact an attorney. According to the criminal complaint, Ms. Froysland was given a second breath test around 11:13 PM, which showed her breath alcohol concentration was 0.14, 1.75 times the legal limit.

Kizzie Froysland would end up being charged with one Felony and two misdemeanors:

  • Felony Fleeing a Peace Officer in a Motor Vehicle
    Maximum Sentence: 0-3 years plus one day and/or $1,500-$5,000 fine

  • Misdeanor 4th Degree Driving While Impaired (Under the Influence of Alcohol)
    Maximum Sentence: 0-90 days and/or $300-$1,000 fine

  • Misdeanor 4th Degree Driving While Impaired (0.08 or More)
    Maximum Sentence: 0-90 days and/or $300-$1,000 fine
