Burnsville Man Sentenced to 12 Years in Prison for Sexual Abuse Crimes Involving Minor

BURNSVILLE, MINNESOTA – Eslin Agustin Bautista Perez, a 23-year-old resident of Burnsville, has been sentenced to 12 years in prison following his guilty plea to charges related to the sexual abuse of a minor. The sentencing hearing occurred on April 8, 2025, in Dakota County District Court. Court documents reveal that the sentence included a downward departure from standard sentencing guidelines due to the defendant’s demonstrated remorse and early guilty plea.

Convictions and Sentencing Details

Bautista Perez pleaded guilty to Criminal Sexual Conduct in the First Degree (Victim under 14) and Possession of Pornographic Work Involving Minors (Minor under the age of 14). A third charge of Use of Minor in Sexual Performance or Pornographic Work was dismissed as part of the plea agreement.

Count 1: Criminal Sexual Conduct in the First Degree

  • Sentence: Bautista Perez was sentenced to 144 months (12 years) at the Minnesota Correctional Facility in St. Cloud. He will serve two-thirds of this sentence (8 years) in prison and one-third (4 years) on supervised release. Upon release, he will be subject to a conditional release period of 10 years.

  • Downward Departure: The court acknowledged Bautista Perez’s remorse, which he expressed during sentencing, and his early guilty plea as mitigating factors in determining the sentence length.

  • Additional Conditions:

    • Mandatory DNA sample submission.

    • Registration as a predatory offender.

    • No contact with the victim.

    • Completion of a psychological-sexual evaluation and compliance with all recommendations.

    • Restitution reserved for determination within 60 days.

Count 3: Possession of Pornographic Work Involving Minors

  • Sentence: Bautista Perez was sentenced to an additional 12 months, served consecutively with his conviction for Count 1. This sentence also reflects a downward departure from sentencing guidelines.

  • Additional Conditions:

    • Similar conditions as Count 1, including DNA sample submission, predatory offender registration, no contact with the victim, psychological evaluation, and restitution determination.

Case Background

The charges against Bautista Perez stem from incidents that occurred between June 1, 2024, and August 18, 2024. Police discovered the abuse after encountering Bautista Perez and his victim—a relative— in a van at Alimagnet Park in Burnsville around 2 AM on August 18, 2024. Subsequent investigations revealed that Bautista Perez engaged in multiple sexual acts with the victim and recorded explicit videos involving her.

Evidence recovered from Bautista Perez’s phone included videos showing sexual acts with the victim, who was only 12 and 13 years old at the time. He admitted to knowing her age and creating a fake Snapchat account to communicate secretly with her.

Court’s Considerations for Sentencing

During sentencing, Bautista Perez expressed remorse for his actions. The judge cited his words in court as evidence of genuine contrition. Additionally, his early guilty plea allowed authorities to avoid a lengthy trial and spared the victim from further trauma associated with testifying. These factors contributed to the court’s decision to impose a downward departure from standard sentencing guidelines.

Legal Consequences

Despite the downward departure, Bautista Perez will remain incarcerated until at least April 2033 before being eligible for supervised release. Upon release, he will face strict conditions aimed at ensuring public safety.
