Sioux Falls Man Charged with Felony Firearm Possession and Fleeing Police After Pursuit in Eagan
EAGAN, MINNESOTA —A Sioux Falls man is facing multiple felony charges after allegedly leading police on a pursuit and being found in possession of firearms, despite a prior conviction for a violent crime that makes him ineligible to own weapons.
Marco Antonio Sherman, 29, was charged in Dakota County with felony possession of a firearm by an ineligible person and fleeing a peace officer in a motor vehicle following an alleged incident on Friday, October 11, 2024.
According to the criminal complaint from the Dakota County Attorney’s Office, an Eagan Police Officer attempted to stop Sherman's vehicle after observing a traffic violation at around 1:04 p.m. on Friday, October 11, 2024. Instead of complying, it was alleged that Sherman pulled into a gas station before rapidly accelerating and fleeing the scene. He led officers on a brief chase, weaving through the gas station, before driving over a curb and losing a tire. The vehicle came to a stop in a nearby parking lot, where Sherman and a female passenger allegedly fled on foot.
Sherman was apprehended after the officer allegedly threatened to use a taser. According to the criminal complaint, during his arrest, Sherman refused to provide a statement but claimed that his female passenger was “not involved.” The passenger was later apprehended and allegedly found to be carrying a loaded handgun, which she allegedly said Sherman had handed to her.
The criminal complaint states that further investigation revealed a black bag on the driver’s seat floor allegedly containing a loaded 9mm handgun and additional ammunition. In the trunk, the criminal complaint states that police allegedly discovered a deconstructed AR-style rifle and more ammunition. According to the criminal complaint, Sherman’s criminal record includes a 2017 felony kidnapping conviction in South Dakota, which is a violent crime that prohibits him from possessing firearms or ammunition. Additionally, Sherman reportedly had an active warrant for a parole violation related to his kidnapping conviction. He has been on supervised release from prison in South Dakota according to court records.
Sherman faces serious consequences, with court documents showing the charges carry a combined maximum sentence of up to 18 years in prison and fines of up to $35,000. Court records show that attornies with the Dakota County Attorney’s Office requested bail be set at $100,000 without conditions and $75,000 with conditions. However, court records show that bail was ultimately reduced to $40,000 with conditions or $100,000 without.
Sherman’s next court hearing is scheduled for October 30, 2024, at 1:30 p.m. These charges are merely allegations, and the defendant is presumed innocent until proven guilty in a court of law. Further updates on this case will depend on the progress of the legal proceedings.
